USER-CUSTOMER INFORMATION

GENERAL CONDITIONS OF SALE


1. SCOPE OF APPLICATION

1.1. The purchase of the products presented on our site ("calze-carezza-shop.it"), managed by CRE Calzifici Riuniti Elli srl (hereinafter "CRE srl"), with headquarters in via Palermo, 36 - 21057 Busto Arsizio (VA ), tax code and VAT number 00747510121 is governed by these General Conditions of Sale ("GCS").

1.2. The GCS apply to anyone who places a purchase order through socks-carezza-shop.it (the "Customers"), with the exception of the provisions that refer to the provisions of articles 50 to 63 of Legislative Decree no. 206/2005, applicable exclusively to natural persons who purchase the products for purposes unrelated to any business or professional activity carried out (the "Consumer Customers"); it is assumed that the Customer who sends a purchase proposal by entering his VAT number in the area relating to the Customer's personal data is not a Consumer Customer.

1.3. These GCS apply to every order placed and forwarded to CRE Calzifici Riuniti Elli srl through socks-carezza-shop.it (the "Order") and to every contract that is subsequently concluded according to the methods set out in Section 3 (the " Contract").

1.4. These GCS are an integral part of the purchase contract for any Product, therefore, by submitting an order, the customer accepts them.

1.5. CRE srl may modify the content of these GCS at any time, the modifications will become an integral part of the new Contracts starting from the first Order submitted by the Customers after their publication on the Site. Orders already forwarded with the publication of the modifications on the site will be subject to the previous version of the GCS.

1.6. The products on sale on the Calze-Carezza-shop.it website are intended exclusively for end users of the products purchased and not for individuals who intend to resell the products purchased on the website; CRE srl will be able to check at any time whether customers act as resellers and in this case cancel the contracts that have been concluded with them.


2. DOWNLOAD AND CONSULTATION OF THE TERMS AND CONDITIONS OF THE AGREEMENT

2.1. The Customer can print and/or save a copy of the GCS, and of the documents that make up the Contract relating to the Products purchased on the Site, using the normal functions of his browser (e.g.: "File" -> "Save as" ), or download it in PDF format and archive it.

2.2. The Customer will be able to archive the data of his Order, both by downloading the GCS and saving the data summarized on the last web page that precedes the forwarding of each Order, and by saving the emails that Calze-carezza-shop.it will subsequently send to the Customer , which will contain the order data.


3. PURCHASE PROCEDURE AND CONCLUSION OF THE CONTRACT

3.1. The presentation of the products on the Site constitutes an invitation to the users of the Site to place an order. Invitations to users are not binding for CRE srl and do not constitute offers to the public (pursuant to and by effect of article 1336 of the Italian Civil Code).

3.2. To proceed with the purchase of one or more Products via the Internet, it is necessary to register on socks-carezza-shop.it by providing CRE srl with the data necessary to allow the Orders to be completed, in compliance with the provisions on the protection of personal data .

3.3. Once registration has been completed, the Customer will be able to select the product or products he wishes to purchase and add them to the virtual "cart", whose contents he will always be able to view.

3.4. By clicking on the "Proceed to purchase" button, you start the order forwarding procedure. During the formulation of the Order and until its actual forwarding, it will be possible to review the data entered by clicking on the "Back" button, so as to identify and correct any errors.

3.5. By clicking on the "Complete the Order" button, at the end of the procedure, the Customer sends the Order. Each Order submitted following the methods described above will be considered, to all intents and purposes, a contractual proposal by the Customer.

3.6. The availability of the Products indicated on the site may not be updated in real time and, in the event of numerous simultaneous accesses, the actual availability of the individual Products may vary significantly during the day. Before accepting an Order, CRE srl reserves the right to check the actual availability of the Products covered by the Order.

CRE srl can decide whether or not to accept the Orders received without, in the event of non-acceptance, the Customer being able to advance rights or claims against CRE srl for any reason.

3.7. The Order will be considered accepted and the Contract will be considered concluded only when the Customer receives, at his e-mail address, the express confirmation of acceptance of the Order (the "Order Confirmation").


4. PRICE AND SHIPPING COSTS

4.1. The prices of the Products published on the homepage or in the various sections of the Site are expressed in euros and include VAT, when applicable, but do not include customs duties and charges.

Shipping costs are not included in the price, unless otherwise indicated during the Order submission process.

4.2. CRE srl reserves the right to change the prices of the Products listed on the Site at any time. Any changes to the prices of the Products will not affect orders already placed.


5. PAYMENT AND DELIVERY

5.1. The customer must use one of the payment methods proposed by CRE srl during the order forwarding process on socks-carezza-shop.it.

The different payment methods are: payment by credit card, bank transfer, Paypal.

5.2. The Customer will pay the full price of the Products ordered at the time of placing the Order by credit card, Paypal, or subsequently and independently by bank transfer to the IBAN that will be communicated during the procedure.

If the order is not accepted, CRE srl will refund the Customers any amounts already paid.

5.3. The payment document will be issued in electronic format, the fiscal document will be issued in the format of an electronic invoice sent by email to the customer.

5.4. CRE srl will ship the Products ordered by courier within 3 (three) working days from the Order Confirmation or, in case of payment by bank transfer, from the crediting to CRE srl.

At the time of shipment, CRE srl will communicate to the Customers the data that will allow the transit of the package to be verified.

5.5. CRE srl will not be responsible for failed or delayed delivery due to force majeure (such as strikes, provisions of the Public Authority, transport difficulties, fires, floods, etc.).

CRE srl will promptly notify the Customer of the occurrence and disappearance of a cause of force majeure. If the cause of force majeure persists for a period exceeding 30 days, each of the parties will have the right to withdraw from the contract.

In the event of withdrawal due to force majeure, the Customer will not be entitled to any indemnity or compensation for any reason, but any amount already paid by way of price for the Product covered by the Order will be returned to him, within 30 (thirty) days from sending the Order.

5.6. CRE srl is responsible for the products until they are delivered to the transport carrier, regardless of whether or not the shipment of the Products is insured.

5.7. Before accepting the Products from the courier, upon delivery, the Customer is required to carefully inspect the package. If the packaging appears to have been tampered with or if the adhesive tape is not intact, the Customer must note it on the receipt of the Products that he issues to the courier or he can refuse delivery and contact CRE srl at the email address info@calze-carezza-shop.it within two successive working days, to allow CRE srl to take action against the courier. If the Customer accepts tampered packages without notifying the courier, CRE srl is not liable for damage or shortages relating to the delivered Products.


6. WITHDRAWAL, RETURN, REPLACEMENT

The customer has the right, pursuant to and for the purposes of Article 64 of Legislative Decree n. 206/2005, to withdraw from the sales contract, without specifying reasons, within 15 (fifteen) days from the date of delivery of the products, without any penalty.
Pursuant to art. 52, paragraph 1, lett. (f) and (g) of the Consumer Code, the terms and conditions of the right of withdrawal in favor of consumers are indicated below.

6.2. The Consumer Customer can withdraw from the Contract via the electronic procedure indicated in the Withdrawal/Return Procedure section . The right of withdrawal applies to the consumer customer who intends to exercise it according to two cases:

1) Right of withdrawal for goods not yet shipped: The customer can withdraw from the purchase at any time before the goods have left our warehouses, or before they have been sent for delivery. In this case he will receive a full refund including shipping costs.

2) Right of withdrawal for shipped goods: Since the goods being sold are of an intimate nature, CRE grants its customers this right only if the products have not been tried on, worn, or removed from their packaging. The costs for the return shipment are borne by the buyer. The return shipping address is:

Once the return has reached our warehouses, if the goods meet the conditions described below (6.3), we will proceed with a refund - shipping costs are excluded from the refund.

6.3. The consumer customer who intends to exercise the right of withdrawal must return the products under the following conditions:

- correctly packed in their original packaging, in perfect condition for resale (not ruined, damaged, dirtied, worn, with intact packaging) and equipped with all possible accessories, instructions for use and documentation;

- possibly equipped with the transport document (present in the original packaging), in order to allow CRE srl to identify the customer (Order number, name, surname and address);

- without having been worn or tried on, or removed from their transparent internal packaging.

If the returned Products do not comply with the conditions described, the withdrawal will not be effective.

6.4. If the right of withdrawal has been exercised following the methods and terms indicated above, respecting the conditions, CRE srl will reimburse the relative price paid within 7 (seven) days from the date on which CRE srl received the returned package, or to issue a voucher for the value of the returned products to be spent on the Carezza-shop website, if requested by the customer. Otherwise CRE srl will notify the customer of the ineffectiveness of the withdrawal; it will be possible for the customer to get the returned products back with shipping costs at his expense.

In any case, the risks associated with the destruction or damage of the returned Products during the shipment are the responsibility of the Customer; if the Products are not considered intact, the withdrawal will not be effective.

The shipping costs associated with returning the Products are charged to the customer.

7. WARRANTY AND CLAIMS HANDLING

7.1. The provisions of the law regarding guarantees apply to purchases by consumer customers, including those provided for by the Consumer Code in relation to consumers.

7.2. If the products are defective or altered, the Customer can contact CRE srl according to the methods indicated in these GCS and request their repair or replacement. The choice between repair or replacement is entrusted to the Customer, unless the chosen remedy is objectively impossible or excessively onerous compared to the other. The complaint by the Consumer Customer must be made within 1 day of discovery and, in any case, within 2 days of delivery of the Products, under penalty of forfeiture. It must be documented by photographs and described by email to info@calze-carezza-shop.it.

7.3. CRE srl will, depending on the case, carry out the repairs and replacements requested within a reasonable period of receipt of the Customer's request. The Customer must describe the nature of the defect or alteration found in as much detail as possible and send a copy of the Order documents or indicate the Order number, the Customer number, and the data useful for identifying the complaint. If no response is received by the Customer within 5 (five) working days, the Customer is invited to request a response.


8. DATA PROTECTION

CRE srl reserves the right to keep the data of each Order and the Customer's contact details. This information will be used only to allow the correct execution of the Order (also through the transmission to third parties involved in the management of the payment, in the execution of the Order and/or in the shipment of the item), of any complaints regarding the guarantee of the article and/or recommendations or instructions to the Customer concerning the article. The storage and processing of data will take place in accordance with the content of the privacy policy on the protection and use of personal data by CRE srl.

The customer will be able to access this confidential information only after having logged in to the reserved area of ​​the Site called "My account", by entering the access credentials that were assigned to him when registering on the Site.

Once logged in to the reserved area, the Customer will be able to consult the Contracts already concluded, the Pending Orders, update and save their contact details, any bank details and/or data relating to the subscription to the newsletter service. The Customer undertakes to treat his access credentials to the aforementioned reserved area of ​​the Site in a confidential manner and not to make them available to third parties.

9. APPLICABLE LAW AND DISPUTES

These General Conditions of Sale and the Contracts are governed by Italian law.

If the Customer decides not to make use of the telephone service, all rights and faculties granted to the customer by law remain unaffected and unaffected.
